Yes, they can bring a claim through their adult guardian and the claim is dealt with in exactly the same way as an adult claim with one exception namely, that upon the case reaching its conclusion and settlement being imminent the Court will have to decide whether the settlement is to be approved.    

The Court will only do that if it thinks it is a fair settlement. This is to protect the child against the case settling at a too low a level. The Court will order that the compensation be paid to into the Court and the Court holds it and invests it, and obtains interest and retains the money until the child is 18 years of age when it is then paid out in full to the child.

When your case is settled it will be settled on the basis that as well as you receiving your compensation the paying party will also pay your legal costs.   That is if you win your case.   If you lose your case then so long as you have co-operated with us, there will be no charge for the work carried out.

You have until you are 21 years of age or 3 years from the date of the accident or the date that you realise that you had been injured in an accident whichever is the later. If you think that your claim may be outside the 3 year period then the Court does have discretions in certain circumstances to allow a claim to proceed, so it is always worth contacting us. There are also complicated rules about when the 3 years starts to run so if you are in any doubt whatsoever then it will cost you nothing to contact us.
