While cartoon strips have, for years, depicted ferocious dogs hanging from the legs of hapless postmen, the risks of dog attacks and the infliction of serious harm on the victim are very real. In 2005, a two-year-old girl from Carmarthenshire, Wales, was attacked by her neighbour's dog - an Akita Japanese hunting dog - when returning a video with her father.

The girl suffered horrific injuries that nearly killed her, including a torn ear, a compressed skull and multiple wounds to her face. Two years on, in 2007, the girl and her family received £20,000 compensation for her injuries and the emotional damage they have suffered as a result.

Expert breeders say the dog should have been kept away from children, as it is specifically bred to be violent in order to bring down bears from the mountains in its native country. Cases such as these have roused the government into action over the last twenty years, and they have put in place strict regulations to prevent the breeding and trading of dangerous dogs.

In 1991, the government brought in The Dangerous Dogs Act, which prevents the ownership and trade of four of the most dangerous dog breeds. The dog breeds banned in the UK are the Pit Bull Terrier, Japanese Tosa, Dogo Argentino and Fiza Braziliero. However, even more breeds have come under question in recent years as the result of unprovoked attacks on humans. Those who believe they may have a compensation claim following a dog attack should seek legal advice immediately.

Rural dwellers claim rising petrol prices are driving them off the road

http://www.accidentlaw.ltd.uk/item/news/rural-dwellers-claim-rising-petrol-prices-are-driving-them-off-the-road-_7335_8385.aspx

The soaring cost of petrol and diesel is forcing drivers from rural areas to reduce visits to family and friends living elsewhere, according to a recent survey from the RAC.

Prices at the pumps reached 136p per litre for petrol and 140p for diesel in some places last week, and drivers are feeling the pinch.

Combined with the rising cost of insurance premiums, car owners are struggling to maintain their transportation habits.

Those living in rural areas have been hit worst, due to the higher average distance travelled to work or to visit family, and the lack of other means of transportation that urban dwellers can take advantage of, such as buses or trains. This has meant that, while people living in the countryside may want to decrease their car usage, for many, it is just not a viable option.

The survey also stated that 75% of all UK car owners have been forced to alter their driving habits in some way, by either reducing the number or lengths of journeys taken, or reducing spending in other areas such as leisure and entertainment.

Tesco has stolen the headlines in recent days for its price reductions on petrol and diesel - by up to 3p a litre in some areas. The leading supermarket chain says that it hopes the move will leave its customers more money to spend in store.

Whether decreased car usage around the country will result in a reduced number of road accidents and compensation claims remains to be seen.

Ryanair passengers are given the “tools” needed to claim

http://www.accidentlaw.ltd.uk/item/news/ryanair-passengers-are-given-the--tools--needed-to-claim_7335_8376.aspx

Disgruntled Ryanair customers are being given the tools to file their own compensation claims arising from cancellations and delays.

Claims-handling firm EUclaim are now offering an online service that allows passengers that feel they have been wrongly treated by the Irish airline to enter in their details and then advises as to whether they have a legitimate claim.

The system works via a new database, built by EUclaim, which monitors flights and cross-checks customer details to see if the reasons given by Ryanair to justify the cancellation or delay - which, EUclaim says, normally centre on “safety concerns” - are accurate.

The company then charges a one-off fee of £22 for the instructions on how to bring a case against Ryanair.

EUclaim says it brought thousands of successful claims against Ryanair since its establishment in 2008; most of which, it says, were related to overbooking. Legislation states that an airline must pay anywhere from £220 to £530 compensation per passenger for a cancellation.

This year, Ryanair bosses announced that they would refuse to have any more dealings with the company in an apparent attempt to avoid losses.

EUclaim quickly hit back by launching its new advisory service just weeks after. So far, the firm says, it has had a very positive response from customers, who felt they did not know where else to turn for help in getting compensation.

The airline has also come under fire in the last few years for some of its attempts to increase profits, such as its idea of offering standing places on flights and plans to introduce fees to use the onboard toilets - both strategies were thrown out due to health and safety concerns.

Make A Work Accident Claim

http://www.accidentlaw.ltd.uk/item/news/make-a-work-accident-claim_7335_8355.aspx

Every employer has a legal duty of care towards their staff. This means that they have a duty of care and face serious penalties if they do not meet very strict health and safety regulations. All employers should be aware of this requirement on their part, and, in recent years, much progress has been made in the fields of proper working conditions and a safer environment. Despite this, however, over a million people a year in the UK are injured whilst simply trying to do a day's work and earn a living wage. Every such accident represents a failure on an employer's part and represents a situation in which the victim of negligence may well be in a position to pursue a work accident claim, pursuing fair compensation for such things as pain, suffering and any associated loss of earnings.

Accidents at work could take the form of slips and trips on badly maintained floors or litter and loose cables which have been left unattended, injuries due to poorly maintained equipment or second rate safety procedures and illnesses or conditions brought on by a dangerous working environment, such as Repetitive Strain Injury (RSI), Vibration White Finger and Industrial Deafness.

Many people feel hesitant when considering launching a work accident claim, worrying about their future employment in the event of taking on their boss, but such concerns are unfounded. No matter what the circumstances, your employer will be insured, and so it will be the insurer who pays any compensation, not your employer themselves, and the law states that anyone making a claim must be treated fairly. What this means is that the decision to make a work accident claim should be based on the circumstances of your case and needn't be hampered by any fears of being discriminated against, unfairly treated or wrongfully dismissed.

Make a Car Accident Claim

http://www.accidentlaw.ltd.uk/item/news/make-a-car-accident-claim_7335_8354.aspx

The injuries which you're likely to suffer following a car accident can be very different in terms of severity and type. It could be that you have the good fortune to walk away from a car accident having experienced only some slight bruising or a few minor cuts, but equally it's possible that a car accident could result in long term, serious, life disrupting injuries. Amongst these injuries could be conditions as genuinely serious as permanent disability, the removal of badly damaged limbs or severe disfigurement. Even the most frequently occurring car accident related injury, whiplash, whilst usually seen as being fairly trivial, can, actually, result in long term pain and intense suffering.

If you have been the victim of a car accident for which you were not to blame then you may be in a position to make a car accident claim and seek compensation for your injuries. Whilst no money can totally make up for the distress and shock caused by a car accident, a car accident claim can help in the short term on a strictly practical level, whilst also seeming like a step towards long term recovery. It doesn't matter if the accident was brought about by another road user, a pedestrian or a neglected road surface, if someone else was to blame then you could be in the position to pursue a car accident claim on a no win no fee basis.

A car accident claim isn't dependent on your injuries. They don't need to be obviously major or life threatening for your claim to be reasonable. Even a smaller injury can lead to time off work which will result in lost earnings, and other expenses may include the cost of medical care, travel and transport requirements and prescriptions.

Datamonitor: Personal injury costs on the up

http://www.accidentlaw.ltd.uk/item/news/datamonitor--personal-injury-costs-on-the-up_7335_8297.aspx

The cost of personal injury claims is set to rise to almost £10 billion by the end of 2014, according to a new report published this month.

According to a report from market analysts Datamonitor, reported by Insurance Age, those in the personal injury insurance industry are likely to face costs of some £9.7 billion over the next three years, a rise from the £8.4 billion reported last year.

The rise will be fuelled by the growing number of personal injury claims for motor incidents, the report predicted. The market analysts also pointed out that such claims currently account for almost 80 per cent of all personal injury claims.

Analyst at Datamonitor Barbara Kubis-Labiak cited the amount of advertising of personal injury services as one of the reasons for more claims.

"With the continued aggressive TV and marketing campaigns by solicitors and claims management companies, there has been a rise in disproportionate claims, with exaggerated claim sizes and unnecessary costs, making regulatory changes essential," she claimed.

Miss Kubis-Labiak said that over the next few years, changes to personal injury legislation may help to stem rising costs, but said that this would only lead to a "marginal slowdown" in spiralling expenses.

Personal injury specialists advise on making a claim

http://www.accidentlaw.ltd.uk/item/news/personal-injury-specialists-advise-on-making-a-claim_7335_8288.aspx

Those looking to make a claim for personal injury in the workplace or a car accident have been offered some advice from a personal injury expert.

A group said that while road crashes "are something most of us will have the misfortune to deal with at least once in our lifetime" taking on a personal injury firm to get the compensation "which you are rightfully owed" is a vital step after an accident.

According to the personal injury firm, the most important thing to do when involved in a road traffic accident is to get the details of the other driver. While it sounds an obvious thing to do, the firm noted that the stress of a crash can push this essential aspect of making a claim out of a driver's mind.

Important details which are needed to make a claim include the other motorist's name, their car registration number and the name of their car insurance provider.

Taking pictures of the scene of a crash and damaged cars is also advised.

"The car accident report from police can really be the main information to rely on in a personal injury claim. The police report contains information like addresses and name of witnesses, traffic and citations violations, description and diagram of accident site and many more details. It will prove you were not at fault which means you are entitled to compensation so be sure to keep hold of the police report," the group also explained.

Personal injury expert: Personal injury claimants should get more money

http://www.accidentlaw.ltd.uk/item/news/personal-injury-expert--personal-injury-claimants-should-get-more-money_7335_8279.aspx

Some people who make claims for personal injury are not being awarded with enough cash, a personal injury expert has said.

According to president of the Association of Personal Injury Lawyers David Bott, a 10% increase in the average amount of cash awarded to those who are successful in civil cases is still not acceptable.

Bott said that when this figure is compared with recommendations on damage payouts given by the Law Commission, it falls short. The Law Commission claims that winners of civil cases should, in some cases, be awarded up to 50 per cent more than they can currently expect.

He claimed that recent reforms in the civil litigation field will be of no benefit to claimants and will only act as a boost to defendants in personal injury cases.

"It is bitterly disappointing that the Ministry of Justice is still seduced by the myth of a so-called compensation culture when Lord Young, who conducted a review of health and safety and litigation, said in his report that it is more perception than reality", he said.

Speaking earlier this year, the personal injury expert warned that changes to personal injury law and standards will lead to a need for more flexibility among lawyers in the field.

According to figures reported by the Times Educational Supplement, one unidentified teacher was awarded £200,000 after a slip on a school staircase saw them eventually have to give up work, with the subsequent fall making an existing hernia problem worse and leaving them in "chronic" pain.

As well as this, one teacher was awarded £459,000 after a pupil pushed her onto a filing cabinet, leaving her with such serious back injuries that she was left wheelchair-bound.

Further cases included that of a teacher who was awarded compensation payments totalling £426,000 after she was left with breathing difficulties after being sprayed in the face with an aerosol by a disruptive pupil.

Commenting on the figures, General Secretary of the NASUWT teaching union Chris Keates warned that there is a lack of protection for those working in the profession and that following further cutbacks to rights, claims for compensation will "undoubtedly rise in future".

However, some may think that teachers already have a better shot at getting compensation following an incident at work - commenting on the story when it was published by the Daily Mail, one reader claimed that in a decade of working in supermarkets, she had been subject to physical and mental abuse by customers with no chance for compensation.

Council reveals drop in road accidents

http://www.accidentlaw.ltd.uk/item/news/council-reveals-drop-in-road-accidents_7335_8258.aspx

Car accident compensation claims in Thurrock could fall after the local council announced a sharp drop in the number of road accidents in the area.
The council said that the main reasons for the fall in the number of incidents were better training for pedestrians and cyclists as well as the In Car Safety scheme, Twilight Trails, the Be Bright Be Seen scheme and the Kerbcraft scheme.

He made his comments on Workers' Memorial Day, an annual event aimed to remembering those who have lost their lives or been injured in workplace accidents. Mr Urpeth said that there is a need for more support for the families of people killed in the workplace and warned the effect of spending cuts will soon become clear.
The regularity of reporting incidents falls to every eight years for companies of a similar size in the service sector, the report found.
Commenting on the figures, occupation safety adviser at the Royal Society for the Prevention of Accidents Roger Bibbings said: "This is such a long interval that corporate memory of the requirement and how to meet it would certainly have evaporated. While at first glance, an accident involving a vehicle crashing into the back of another is the fault of the driver travelling behind, if the motorist in front sharply applied their brakes for no reason or made a manoeuvre without any warning, then it is certainly not as black and white when it comes to making a claim for payment.
If you were involved in a crash which saw you drive into the back of another car, it is certainly worth contacting a car accident compensation specialist to discuss whether you might be eligible for compensation for injury or damage to your vehicle.
Those who have suffered injuries at work can make several types of claims, and are entitled to take action if the incident was the fault of other employees, poor workplace health and safety management, or insufficient supply of equipment for a certain task.
An example of a situation where an employee would be well within their rights to put in a workplace accident compensation claim is if they were asked to work at height, up a ladder for example, and they fell from the ladder due to it not being the right kind for the job at hand.
The most important thing for car accident compensation claimers to remember is that they should have as many details to hand as possible when making a claim, and they should also take action to be compensated for loss of work hours, injury or a damaged car as soon as possible after a collision.

There is also of great concern to accident claims companies such as Lavin Copitch, as it is putting a strain on their services, and if it were the case that the a pre-planned car accident won an accident claim, then it could throw that company into disrepute.

The issue of safety is also a major factor. As yet, no fatalities have been recorded as being part of a pre-meditated car accident, and as far as the police are concerned that is a miracle. The fact that some people are showing such little regard for their own and their community’s safety illustrates the desperate measures some people will go to in order to get insurance pay outs.

In order to tackle this problem, insurance companies are being encouraged to work closely with police in order to tackle this kind of fraud and this means difficult times for both insurance firms and accident claims companies.

The driver in question was racing along an A road in the early hours of the morning in February last year. A witness reported seeing the driver overtaking them, despite them travelling at nearly 60 mph (the speed limit) and in bad driving conditions as it was dark and wet.

The witness then saw the man try twice to overtake a lorry and bus nose to tail, attempting to pass them both at the same time. The second time the man attempted to overtake he smashed into a car coming the other way, on the other side of the road.

Car Accident Claims like this take into account the injuries sustained and any emotional trauma. The male driver of the other car suffered whiplash and his pregnant passenger, his wife, sustained a broken collarbone and hand. The couple were also compensated for the time they had to take off work, as well as anxiety for their unborn child.

The man received a three year driving ban and a suspended jail sentence. He must also complete 200 hours of unpaid community service.
